Online Wedding

An online wedding (also known as a proxy marriage or virtual wedding) allows couples to legally marry without being physically in the same location. This option is especially valuable for international couples, including those seeking U.S. immigration benefits through spousal sponsorship.

Under U.S. immigration law, a proxy marriage is only recognized for immigration purposes if the marriage is later consummated (physically together after marriage). Couples using an online wedding for a CR1 or IR1 visa must meet this requirement to be eligible for a spousal visa.

Requirements for an Online Wedding

To ensure your online wedding is legally valid and accepted for immigration, you must meet the following conditions:

Legal Recognition of Online Marriages

Jurisdiction: The marriage must be performed in a place where online weddings are legally recognized (Utah, for example).
Officiant & Marriage License: The ceremony must be conducted by a licensed officiant, and a legal marriage license must be issued.
Documentation: Both parties must provide valid identification and follow all local requirements.

Immigration Recognition of Online Marriages

USCIS & State Department Requirement: A proxy or online marriage is only valid for U.S. immigration if the marriage is consummated (spouses must physically meet after marriage).
Proof of Relationship: Strong evidence of a bona fide marriage, including:

Photos, travel records, and hotel receipts from after the marriage
Communication records (messages, calls, emails)
Financial support proof (joint bank accounts, money transfers, shared bills)

💡 If the marriage is not consummated, it will NOT be valid for U.S. spousal visas (CR1/IR1). In this case, a K-1 fiancé(e) visa may be a better option.

Step-by-Step Process for an Online Wedding

1. Choose a Jurisdiction & Obtain a Marriage License
– The easiest and most widely recognized online marriage option is through Utah County, Utah.
– Couples can apply for a marriage license online through the Utah County Clerk’s office.
– Both partners must provide valid identification (passport, state ID, or driver’s license).

2. Virtual Wedding Ceremony
– The ceremony is conducted via video call with a licensed officiant.
– Witnesses may be required, depending on the jurisdiction.
– The ceremony follows standard marriage vows, and couples are declared legally married.

3. Receive the Marriage Certificate
– After the ceremony, the official marriage certificate is issued and can be downloaded or mailed.
– Ensure the certificate is properly notarized and certified for legal and immigration purposes.

4. Consummate the Marriage (For Immigration Purposes)
– To be valid for spousal visas (CR1/IR1), the couple must meet in person after the wedding and provide evidence of consummation.
– If the couple cannot meet, the online wedding will not be recognized for immigration, and a K-1 fiancé(e) visa may be necessary.

5. Use the Marriage for Immigration Applications
– Once consummated, the marriage can be used for Form I-130 (Petition for Alien Relative) to apply for a spousal visa.
– The petition must include proof of the wedding, meeting, and a bona fide relationship.
